End User Licence Agreement (EULA)

In brief

  • This EULA covers installing and using the Nobamouse desktop application for Windows and macOS. It supplements the Terms of Sale and Use (the “Terms”), which prevail in case of conflict; capitalised terms are defined there.
  • You may install the application on up to three (3) devices for the duration of your Subscription.
  • Your webcam images are processed on your computer and never sent to us.
  • You keep your statutory rights as a software user (backup copy, interoperability) and the statutory guarantee of conformity.
  • Security updates: at least five (5) years from the placing on the market of each major version; security updates are included in the Subscription and provided at no extra cost to holders of a valid licence.

This End User Licence Agreement (the “EULA”) sets out the conditions under which NOBATECH SAS (“NOBATECH”, “we”) grants you the right to install and use the Nobamouse desktop application for Windows and macOS (the “Desktop Application”), with its updates and documentation. You accept it when subscribing and, where applicable, when installing. Nothing in this EULA reduces your statutory rights.

From the Launch Date, this EULA replaces the closed-beta EULA for any new installation or update. Closed Beta Participants remain subject to the previous EULA until they install a version governed by this one or until the end of the Transition Period.

2.1 What you may do

We grant you a personal, non-exclusive, non-transferable and non-sublicensable licence to install and use the Desktop Application, in object code, on up to three (3) devices activated at the same time, which you own or control, for your personal use. You can deactivate a device from your Account to activate another. If the Subscription was taken out by a holder of parental authority for a minor, the minor may use the Desktop Application under the holder’s responsibility; the holder remains the Customer.

Business customers. If you contracted under the Business Terms of Sale, the licensee is your organisation: it may use the Desktop Application for its professional needs and assign each Seat to one (1) named User (employee, pupil or student, person in its care), who may activate it on up to three (3) devices. The organisation is responsible for its Users’ compliance with the EULA; licence codes are handed only to them. In case of conflict, the Business Terms prevail.

2.2 Duration and territory

The licence lasts as long as your Subscription, including any free trial (or, for Closed Beta Participants, the Transition Period) and ends automatically with it (cancellation, withdrawal, refund, termination). It is worldwide; the Service is marketed in the European Union.

2.3 What NOBATECH keeps

The Desktop Application is licensed, not sold. NOBATECH and its licensors retain all intellectual property rights. No other right is granted to you.

Unless the law allows it, you must not: distribute, rent, lend, sell or make the Desktop Application or its installer available to third parties; let another person use your installation through your Account; circumvent the Subscription check, authentication or security; modify, adapt or translate the Desktop Application or create derivative works; remove proprietary notices.

Your statutory rights as a user remain intact (Article L122-6-1 of the French Intellectual Property Code; Articles 5 and 6 of Directive 2009/24/EC): a backup copy needed for use; observing, studying and testing the functioning during operations you are entitled to perform; decompilation to the extent indispensable for interoperability. Any contrary clause is void (L122-6-1 V). Before decompiling, you may ask us for interoperability information at support@nobamouse.eu we reply within a reasonable time.

The Desktop Application is activated by logging in to your Account and periodically checks over the Internet that the Subscription or Transition Period is ongoing. Without a connection, it remains usable for seven (7) days. Only the data described in the Privacy Policy is transmitted.

The installer is downloaded from your Account and may require administrator rights. Minimum requirements: Windows 10 or Windows 11; macOS on a Mac with Apple silicon.

  • Windows: application files, system components needed for input simulation, Start menu shortcuts.
  • macOS: the application in the Applications folder and the third-party driver Karabiner-DriverKit-VirtualHIDDevice (pqrs.org), needed for pointer events. macOS asks you to allow the system extension (System Settings › Privacy & Security), camera access and, where applicable, accessibility.

The Desktop Application checks for and downloads updates. Throughout the Subscription we provide the updates needed to maintain conformity, including security updates, and tell you about their availability, content and the consequences of not installing them (see the Terms). Critical security fixes may be rolled out immediately; where possible they are offered separately from new features.

Supported versions are listed in the Account; the end of support for a version is announced at least thirty (30) days in advance, and a supported version always remains available free of charge. Support period under Regulation (EU) 2024/2847 (Cyber Resilience Act): at least five (5) years from the placing on the market of each major version; security updates are included in the Subscription and provided at no extra cost to holders of a valid licence. The end-of-support date is stated at the time of purchase and in the Account (Article 13(19) CRA).

The Desktop Application accesses the webcam to track your head and face movements. The images are processed locally, in real time; they are neither recorded nor transmitted. It uses the system interfaces needed for pointer control, nothing more.

It stores your settings, calibration profiles, diagnostic logs and an interface cache locally; you can delete them at any time. It does not transmit images or video, screen content, keystrokes, files or data from other applications. What is transmitted (Account and Subscription data, technical diagnostics and, only with your consent, detailed usage analytics) is described in the Privacy Policy and the Privacy Notices.

Nobamouse is general-purpose computer-access software. It is not a medical device within the meaning of Regulation (EU) 2017/745, has no medical purpose and is not intended for the diagnosis, prevention, monitoring, treatment or alleviation of any disease or disability. The Desktop Application is not designed as the only input method for safety-critical operations: keep an alternative input method within reach.

The Desktop Application includes third-party components, notably open-source components and, on macOS, the Karabiner-DriverKit-VirtualHIDDevice driver, subject to their own licences (“About” / “Licences” in the application). This EULA does not restrict the rights those licences grant you.

Report any suspected vulnerability to security@nobatech.eu (see also security.txt). We acknowledge receipt, handle the report under our coordinated disclosure policy and inform users of fixes. Actively exploited vulnerabilities and severe incidents are notified to the authorities under Article 14 of Regulation (EU) 2024/2847.

When the licence ends (Section 2), stop using the Desktop Application and uninstall it; it may stop working at the end of the offline grace period.

  • Windows: Settings › Apps. The uninstaller removes files, system components and shortcuts, and offers to delete your data too (settings, profiles, logs); otherwise it remains in %APPDATA%\Nobamouse.
  • macOS: delete the application from the Applications folder, then remove the Karabiner-DriverKit-VirtualHIDDevice driver and the system extension following the uninstallation instructions, which support provides on request. Your local data (configuration, profiles, logs) is stored in your Library folder ( /Library) and can be deleted manually.

Your local data stays on your device until you delete it.

Statutory guarantees, liability, mediation, governing law and jurisdiction: see the Terms, which apply to this EULA. The EULA exists in French, German and English; the version in the Customer's language (French, German or otherwise English) is binding; in case of discrepancy the French version prevails to the extent permitted by mandatory law.
