Version of 5 November 2026
In brief
- Nobamouse is public and paid, but still in beta: features change more often and some limitations are known.
- The known limitations are listed in Section 3; you accept them expressly and separately when ordering.
- Your rights remain applicable: statutory guarantee of conformity, withdrawal with a full refund and cancellation at any time, under the Terms.
- Your feedback is welcome and optional. No confidentiality obligation.
- Detailed usage analytics are switched on only with your consent.
This Open Beta Addendum (the “Beta Addendum”) supplements the Terms of Sale and Use (the “Terms”) and the End User Licence Agreement (EULA) during the Open Beta; capitalised terms are defined there. It informs you about the particularities of this phase and organises feedback and telemetry. It does not reduce any of your rights: no exclusion of guarantee, no additional limitation of liability, no confidentiality obligation.
The Open Beta starts on the Launch Date (19 October 2026) and follows the closed beta, which was free and by application. The Service is usable every day, but development continues actively: new features, tuning and fixes arrive at a faster pace. The position of Closed Beta Participants is dealt with in the Terms (section “Closed Beta Participants”). The Open Beta ends when NOBATECH announces it.
Updates and changes follow the Terms (section “Supply, updates and changes to the Service”). In addition: we publish release notes for significant changes; features marked “experimental” in the Desktop Application may be modified or removed and are not part of the main features of the Service; a change with a more than minor negative impact gives you the right to terminate the Contract free of charge (Terms).
Before ordering, you are specifically informed that, during the Open Beta, the Service has the following characteristics, which may deviate from what one expects of software of this type. By accepting them expressly and separately (separate checkbox), you acknowledge that they do not constitute a lack of conformity (Article L224-25-14 of the French Consumer Code). Any other defect remains covered by the statutory guarantee.
- Accuracy depends on the environment: pointer accuracy and stability depend on lighting, the webcam and your position; recalibration may be needed after a change of environment.
- Webcam compatibility: some webcams or resolutions may not be supported or may need manual adjustment.
- Resources: real-time tracking can put heavy load on the processor of entry-level computers.
- macOS: operation depends on a third-party driver and system permissions; a macOS update may require a new authorisation or an update of the Desktop Application.
- Experimental features: they may be incomplete, modified or removed.
This list is available at any time in the Account. A limitation added after your order is binding on you only with your express and separate agreement.
You may send us suggestions, bug reports and other feedback (the “Feedback”). This is entirely optional and has no effect on the Price or your rights.
Where Feedback is protected by an intellectual property right, you grant us, free of charge and non-exclusively, worldwide and for the statutory term of protection, the right to reproduce, display, adapt, modify and integrate it, in whole or in part, into our products and services, on any medium, to improve, develop and operate them (Article L131-3 of the French Intellectual Property Code). We are not obliged to use Feedback; your moral rights are reserved within the limits of the law.
Personal data contained in Feedback or posted in any community features (for example a public suggestion board visible to other users) is processed under the Privacy Policy. Do not include sensitive information about yourself, in particular health information, or personal data of third parties.
The Desktop Application transmits technical diagnostics (crash reports, technical events) to the extent needed to supply, secure and keep the Service in conformity (Privacy Policy, Privacy Notices).
Detailed usage analytics (navigation in the application, features used, interaction patterns) are off by default. They are switched on only with your consent (Article 6(1)(a) GDPR; Article 82 of the French Data Protection Act), via the setting provided in the Desktop Application. You can withdraw it at any time in Settings, with no effect on access to the Service, the Price or the lawfulness of past processing.
We inform you of the end of the Open Beta. On that date, the Beta Addendum ceases to apply, except Section 4 for Feedback already sent. Any change to the Terms or the Price linked to that end follows the section “Changes to the Terms and the Price” of the Terms (prior notice, cancellation free of charge).
