What This Agreement Covers
This agreement applies when you submit an application to join the Nobamouse closed beta program. It covers:
If accepted, you’ll need to review and accept a separate Participation Agreement before accessing the beta software.
This Beta Program Application Agreement (the “Application Agreement”) is entered into between NOBATECH SAS, a société par actions simplifiée registered in France with its registered office at 95 rue des joncs, 57455 Seingbouse, France (“NOBATECH”, “we”, “us”, or “our”), and the individual or entity submitting this application (“Applicant”, “you”, or “your”). By submitting an application to join the Nobamouse closed beta program (the “Beta Program”), you acknowledge that you have read, understood, and agree to be bound by the terms of this Application Agreement.
Submission of an application does not guarantee acceptance into the Beta Program. NOBATECH may accept or reject any application at its discretion without providing reasons for its decision.
NOBATECH may consider various factors when evaluating applications, including technical requirements, use case relevance, testing capacity, and diversity of user profiles. NOBATECH is not obligated to disclose its selection criteria.
If your application is accepted, you will be notified via the email address provided in your application. You will then be required to accept the full Beta Program Participation Agreement before accessing the Beta Software.
By submitting an application, you confirm that:
The personal data you provide in your application will be processed in accordance with NOBATECH’s Privacy Policy, available at nobamouse.eu/privacy. We encourage you to review the Privacy Policy before submitting your application.
Your application data will be processed for the purposes of: (a) evaluating your application and communicating with you regarding its status (legal basis: Art. 6(1)(b) GDPR — steps prior to entering into a contract); (b) managing your participation if accepted, in accordance with processing activity BUS-OPE-003 (Product development, legal basis: Art. 6(1)(b) GDPR — contract); and (c) sending waitlist updates and newsletters, in accordance with processing activity BUS-STR-003 (legal basis: Art. 6(1)(a) GDPR — consent).
Your application data will be retained for up to three (3) years to manage waitlist notifications, then deleted or anonymized.
You have the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, or with the competent data protection supervisory authority in the Member State of your residence, place of work, or place of the alleged infringement.
From the moment of application submission, you agree to treat as confidential any information you receive about the Beta Program, including: information about the application process, communications from NOBATECH regarding the Beta Program, and any details about planned features or functionality that may be shared during the application process.
You agree not to disclose, publish, or share any such information with third parties without NOBATECH’s prior written consent.
If your application is not accepted, your confidentiality obligations under this section will expire twelve (12) months from the date of your application submission or upon the public release of the Beta Software, whichever occurs first.
If accepted into the Beta Program, these preliminary confidentiality obligations will be superseded by the more comprehensive confidentiality provisions in the Beta Program Participation Agreement.
NOBATECH undertakes to treat any proprietary or confidential information you disclose in your application with reasonable care and not to use or disclose such information for any purpose other than evaluating your application and managing the Beta Program, except where such information: (i) is or becomes publicly available through no fault of NOBATECH; (ii) was already known to NOBATECH prior to your application; or (iii) is independently developed by NOBATECH without reference to your application.
If your application is accepted, you will be required to review and accept the Beta Program Participation Agreement before being granted access to the Beta Software. The Beta Program Participation Agreement contains important terms regarding your rights and obligations as a beta tester, including provisions relating to intellectual property, confidentiality, liability limitations, and data protection. You will not be permitted to access or use the Beta Software until you have accepted the Beta Program Participation Agreement.

This Application Agreement is governed by and construed in accordance with the laws of France. This does not affect mandatory consumer protection provisions applicable under the laws of your country of habitual residence pursuant to Art. 6(2) of Regulation (EC) No 593/2008.
This Application Agreement constitutes the entire agreement between you and NOBATECH regarding the application process for the Beta Program and supersedes all prior or contemporaneous communications regarding such subject matter.
If any provision of this Application Agreement is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will remain in full force and effect.
